INTRODUCTION
These are the terms and conditions of 80mph in relation to playing live music at your event. Please take the time to read our terms and conditions carefully, before confirming your booking and paying your deposit. All conditions apply to the Band and / or the client.
Our terms and conditions are there to ensure the safety of the Band, the client and all guests, and to offer protection and peace of mind to all parties.
BOOKING PROCESS
There is a 20% deposit to pay at the time of booking, which is non-refundable so please be sure about your dates prior to booking.
The deposit is due within 7 days of confirming the dates (paid by bank transfer). If the deposit, or full payment depending on timing, is not received within the 7 days the booking will be made available to other clients. We are unable to hold dates for customers beyond this period.
The balance will be due 2 weeks before the event, this to be paid by bank transfer. If the balance has not been paid by the specified date the Band has the right to terminate the agreed contract without penalty. Additionally, the client may be liable for cancellation fees.
A receipt will be available for the client by either email or text once all fees have been paid to the Band.
BOOKING CONFIRMATION
Once the event has been confirmed the client will be issued with the following: -
Confirmation of the booking will be issued once the above are received, agreed, and the deposit has been paid.
EXPENSES
Any bookings outside of West Yorkshire may be subject to additional expenses for mileage and/or accommodation expenses – and generally this will be agreed with the Band at the time of booking.
Payment for agreed expenses should be at the time of paying the balance of the booking fee(i.e. 2 weeks prior to the event). Any unforeseen expenses will be discussed (where possible) with you, but if this is not possible all receipts for additional expenses will be passed on to the client after the event and payment must be within 28 days. Expenses may be quoted as an approximate cost at the time of booking.
VENUE ACCESS
Please give the Band information prior to the event if the location off the event is not on the ground floor or requires special access. We usually require a minimum of 90 minutes, but ideally 2 hours, to set up for an event and 60 minutes to pack up after the event.
Bookings with the Band require that we will be given access to set up from 18:00hrs for an evening performance (starting at 20.30hrs) and that we will be departing at no later than 00:00hrs. The second set is assumed to be finishing circa 23:00hrs.
DURATION OF PERFORMANCE
The performance will usually consist of 2x 45-minute sets, the second set will have additional encores therefore usually last approximately 1 hour, with a break in between.
The performance time of the Band will be specified on the booking form, to suit the needs of the client. If the timings of the event are over running due to no fault of the Band, the Band are under no obligation to finish later than the time specified in the booking form and is still due full payment.
BAND RESPONSIBILITY
The Band will be responsible for: -
A copy of the Public Liability Insurance certificate can be provided to any venue that requires it. Our public liability insurance covers up to £10,000,000. All equipment will be PAT tested and in good working order.
Note that the Band’s equipment will not be available for playing the Client’s music/DJ use or similar unless by prior agreement; nor will any lighting equipment be used other than by the Band for purposes of their performance.
CLIENT RESPONSIBILITY
Providing full details of the required performance by completing the booking form in full. The client is to provide a suitable performing area. We are a six-piece Band and require sufficient room to perform for your event, minimum 5m x 4m plus a space for the sound engineer to set up their mixing desk and equipment – they need to be able to set up where they can hear the Band perform “out front” (if you are uncertain about the positioning please let us know and we will do our best to assist).
Unless otherwise agreed, the hirer must provide an electrical supply, meeting or exceeding British Standards. We will require a minimum of 4 x 13amp sockets within the performing area, and a minimum of 2 x 13amp sockets for the separate sound engineer (ideally separate from the performing area).
For any outdoor events suitable dry cover must be provided – and suitable power needs to be provided (see above). If in the event the staging area is waterlogged or in any way unsafe to perform, the Band will not be held accountable and will not set up or perform. The full fee will still be due.
Provide adequate parking for the Band as there is a lot of heavy equipment to transfer from our cars to the venue, parking spaces may need to be reserved, or paid for, if necessary, for use by the Band. In all cases, please notify the Band if parking is limited or restricted.
Provide a suitable and secure place for the Band to change, store cases, spare equipment and personal belongings etc that are not required for the performance.
Ensuring their guests do not interfere with the Band’s performance, and they do not touch or use any of the Band’s equipment. We will not be liable for any injury, charges, or damage arising from touching or using our equipment by the clients, guests or staff at the venue.
If cancellation, curtailment, or non/below par performance results due to venue restrictions, the client will still be liable for fees or cancellation fees.
Please note the venue should have the following licenses, insurances and certificates for the Band’s performance: -
SUSPENSION, DELAY OR INTERUPTION OF PERFORMANCE
In the unlikely event that the performance is delayed or stopped due to events beyond the Bands control then full fees are still payable. This includes but not limited to: -
FORCE MAJEURE
No party will be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature, fire, flood, storm, hurricane, earthquake or other natural disaster, war, terrorist activities, death, illness or other incapacity, epidemic, accident, civil commotion, order of government or local authority or police having jurisdiction in the matter or changes in law.
Any party asserting Force Majeure so as to negate liability shall have the burden of proving it and justifying that they took preventative action wherever possible to counteract the circumstance. If successfully proven, then the cancellation fees outlined above shall be unenforceable.
Should any Band member be unable to perform due to illness or accident, all monies will be refunded in full.
DATA PROTECTION AND GDPR
Each party will keep the confidential information of the other party and any third party confidential, and only use it for the purposes of supplying the services or making proper use of the services. Each party recognises and accepts its obligations with regard to the control and the processing of personal data under the current data protection legislation and regulations.
